If you decide to commence arbitration or file a minor claims claim, you must first send Shutterfly written notice of your claim by registered letter (“Notice”). When Shutterfly initiates arbitration proceedings, it sends a written message to the email address used for your account. A message, whether sent by you or Shutterfly, must (a) describe the nature and basis of the claim or dispute; and (b) provide the specific solution requested (“receivable”). If you and Shutterfly fail to reach an agreement on the settlement of the claim within 30 days of receiving the notice, you or Shutterfly may commence arbitration or file a claim in small claims court.
