An essential element of contract law is that a contract is entered into on a voluntary basis and all parties agree to its terms. Contracts as they operate in law must come from people who freely opt for self-binding agreements. The law requires the formal autonomy, equality and freedom of all individuals. But as we know, these formal principles cannot be responsible for dependence, inequality and oppression, which are inseparable from our lived experience. While contracts may require consent as a condition of their legal validity, consent cannot be reduced to a form of contract. In addition, Latin instinct refers to two dimensions of meaning: meaning as sensation, perception or sensation on the one hand, and meaning as meaning, thought or knowledge on the other. When we think of adhering to the dual meaning of the feeling, the tension between what we perceive or perceive (the physical experience of sex) and what we sign as (the importance of sex) is emphasized. The human experience consists of both senses; and both are at stake in non-consensual sex. If sex is not only an activity, but also a sensible form of communication, then it is like a conversation. It is therefore the responsibility to take care of the interlocutor`s answers. The challenge, then, is to articulate an alternative concept of consent that takes us beyond contract theory. To return to the Latin roots of the word, we can imagine an alternative to the contractual version of consent, which is at the heart of both the policy of consent and non-consensual sex. The consent comes from the Latin con (together, with) and feel (feeling). It`s a deal of feelings. In current conceptions of sex and consent, this agreement of feelings has been reduced to an agreement to do something, or more accurately to allow them to do something. With regard to positive support for gender, it was considered a treatise of a kind, classical conceptions of individual autonomy, which does not take into account the power dynamics by sex, let alone the dynamics of sexual activities. But in Latin, feeling can mean not only feeling, as in emotion or faith, but also feel as in perception or knowledge.
